Wild Kitty Cat Food products are made from real meat and other real ingredients, and in their raw state, they can contain E. coli bacteria or other bacteria similar to other raw meats and other raw animal products. As stated on all of our pet food containers, anyone handling any Wild Kitty Cat Food products should take all necessary precautions to limit any contact with bacteria and should thoroughly wash their hands and all food preparation surfaces after handling the products in an effort to avoid any illnesses that can arise from contact with such bacteria.

Based upon the warnings provided by Wild Kitty Cat Food, Inc., any purchaser of any Wild Kitty Cat Food products, upon the purchase of said products agrees to indemnify and hold Wild Kitty Cat Food, Inc., its officers, directors, administrators, successors and assigns (hereinafter collectively referred to as “Indemnitee”) from any and all suits, claims, judgments, causes of action, damages, costs, and expenses of any kind arising from any alleged injuries associated with the handling of Wild Kitty Cat Food products. Included in this indemnification obligation is the obligation to pay all costs and legal fees incurred by Indemnitee in defending and such claims or in enforcing this indemnification provision.

The purchasers of Wild Kitty Cat Food, by completing the purchase of Wild Kitty Cat Food products, acknowledge that there are certain risks involved in handling raw food products, including the Wild Kitty Cat Food products, and agree that they are assuming any risk associated with the handling of any such items. The purchasers of Wild Kitty Cat Food products acknowledge their responsibility to properly handle any such raw food and will not hold Indemnitee responsible for any illnesses or other injuries arising from the handling of such products.

This indemnification and hold harmless language is intended to be contractual and not a mere recital. The purchasers of Wild Kitty Cat Food products agree that in the event of a dispute regarding these indemnification provisions, the dispute must be handled in the courts in York County or Cumberland County, Maine which courts shall have exclusive jurisdiction over any such disputes and the purchaser of Wild Kitty Cat Food products concedes to the exclusive jurisdiction of those courts.

Indemnitee and any purchasers of Indemnitee’s products agree that upon the purchase of any of Indemnitee’s products by purchaser, in the application of this indemnification provision. Each provision of this indemnification and hold harmless agreement is severable and valid and binding regardless of the validity or invalidity of any clause or clauses in this indemnification and hold harmless agreement. They further agree that the indemnification and hold harmless provisions contained in this Agreement contain the entire Agreement between the purchaser of Wild Kitty Cat Food products and Indemnitee regarding the indemnification and hold harmless terms.

All purchasers of Wild Kitty Cat Food products acknowledge that they have carefully read the foregoing indemnification and hold harmless agreement and know and understand its contents and they have not proceeded with the purchase of any Wild Kitty Cat Food products without carefully reading all of the provisions contained in this indemnification and hold harmless agreement.
